Lizzo is facing a lawsuit over an unreleased track. The GRC Trust brought a copyright infringement lawsuit against the rapper in connection with her provisionally titled song “I’m Goin’ In Till October,” which gained immense popularity after she mentioned Sydney Sweeney’s “Great Jeans” advertisement for American Eagle.

TMZ obtained legal documents on Tuesday, October 21, which revealed that the company claims Lizzo incorporated both instrumental and vocal elements from their copyrighted song “Win or Lose (We Tried).” Videos in question were shared in August, with one of them featuring a four-time Grammy Award winner spraying a red Porsche.

“No Kizzy, he has no business being with me / Fat behind, pretty face with large breasts / B**ch, I have good genes, like I’m from Sydney,” she rapped in the now-deleted video. The GRC Trust is said to be seeking “damages and an injunction to block the exploitation of its song”.

Lizzo’s representatives stated to TMZ that they are surprised the GRC Trust has filed this lawsuit. They clarified that the song has never been released for sale or profit, and no decision has been made about future commercial releases of the song.

What makes this lawsuit unusual is that it involves unreleased songs, but artists can still be held liable for copyright infringement over song snippets. Billboard observed that the stakes would be lower, given the challenge of proving Lizzo garnered substantial profits without selling the allegedly infringing song. It’s probably even more accurate now that the “About Damn Time” creator removed the teaser videos from her social media accounts.

It’s unfortunate that the lawsuit might prevent “I’m Goin’ In Till October” from being released, Lizzo has still given us a lot of great music with June’s album “My Face Hurts From Smiling.” The deluxe version, which appeared several months after the initial release, included nine additional songs featuring the flute-playing artist rapping with intense emotion.
