Diddy Seeks ‘Immediate Release’ From Prison In New Appeal

Diddy has initiated a new appeal to seek release from prison, asserting that his four-year sentence is excessively severe.

The Bad Boy Records founder received a 50-month prison term last year after being convicted on two counts related to the transportation for prostitution, offenses under the Mann Act, but he was acquitted of more serious allegations including sex trafficking and racketeering.

In a recent appeal submitted on March 13, Diddy’s legal team criticized the sentence as a “perversion of justice” and requested either his immediate release with an acquittal ruling or a “vacate and remand for resentencing” order from the court, as reported by TMZ.

The lawyers have accused Judge Arun Subramanian, who oversaw the trial, of employing “acquitted conduct” in sentencing, a practice that has been widely debated for resulting in harsher penalties based on charges that were not proven.

Diddy’s attorneys, who had advocated for a 14-month sentence, contend that the current 50-month term effectively penalizes him for crimes of which he was acquitted. They point out that the length of the sentence is approximately four times the typical duration for Mann Act-related offenses.

The appeal raises the question, “What is the point of a jury trial if your sentence is driven by what you were acquitted of doing?”

The U.S. Court of Appeals for the Second Circuit is set to evaluate the appeal, with oral arguments scheduled for April 9.

Diddy is expected to be released from prison on April 25, 2028, according to information from the Federal Bureau of Prisons.

The 56-year-old is incarcerated at FCI Fort Dix, a low-security federal facility in New Jersey that he selected as his preferred place to serve his sentence.

Shortly after his sentencing, Diddy’s lawyers claimed that this location would best facilitate addressing his drug abuse issues and enhancing family visitation and rehabilitative efforts.

In November, initial photographs of Diddy in prison emerged online, capturing him in relatively good spirits, although with gray hair, while interacting with other inmates in the yard.

However, his time in prison has not been without challenges. Last year, it was reported that he was caught possessing alcohol, specifically a homemade brew referred to as “hooch,” made from Fanta, sugar, and apples.
